Welcome to Silly Little Games LLC ("we," "us," or "our")! By accessing or using our web application games (the "Game"), you agree to these Terms of Service (the "Terms"). If you do not agree to these Terms, please refrain from using the Game.

Acceptance of Terms

By accessing or using the Game, you agree to comply with and be bound by these Terms. If you are using the Game on behalf of an organization, you represent and warrant that you are authorized to bind the organization to these Terms. We may change, suspend or discontinue any aspect of the Game at any time, including the availability of any Game feature, database, or Content. We may also impose limits on certain features or restrict your access to parts or all of the Game at any time without notice or liability.

Being exposed to advertising is a condition of accessing the Game.

If any of the Terms and Conditions of these Terms of Service, or any future changes, are unacceptable to you, you may: (1) cancel your account (see Termination) and/or (2) discontinue your use of the Game. Your continued use of the Game now, or following the posting of updated Terms of Service, will indicate acceptance by you of such Terms of Service, changes, or modifications.

Modifications to Terms

We may change, add or remove portions of these Terms at any time by notifying you of the change by updating the date above after “Last Updated”. Such changes will become effective immediately upon posting. It is your responsibility to review these Terms of Service prior to each use of the Game.

Eligibility

You must be at least 13 years old to use the Game. If you are under 18, you must have the consent of a parent or guardian to use the Game.

Intellectual Property

All content within the Game, including but not limited to graphics, puzzles, source code,  designs and conceptual designs, logos, text, photographs, images, illustrations, audio clips, video clips, “look and feel” metadata, data, compilations, and any other creative materials (collectively, the "Content"), is the exclusive property of and controlled by Silly Little Games LLC and is protected by intellectual property laws.

• By playing the Game, you agree not to copy, reproduce, distribute, modify, publicly display, or create derivative works based on the Content without our prior written consent.

• Unauthorized use of the Content for any purpose, including commercial or personal use, is strictly prohibited.

• Non-commercial use does not include the use of Content without prior written consent from Silly Little Games LLC in connection with: (1) the development of any software program, model, algorithm, or other generative AI tool, including, but not limited to, training or using the Content in connection with the development or operation of a machine learning or artificial intelligence (AI) system (including any use of the Content for training, fine tuning, or grounding the machine learning or AI system or as part of retrieval-augmented generation); or (2) providing archived or cached data sets containing Content to another person or entity.

License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Game solely for your personal, non-commercial enjoyment. You may not sublicense, assign or transfer any licenses granted by Silly Little Games LLC, and any attempt at such sublicense, assignment or transfer will be null and void. This license does not include the right to:

• Copy, distribute, modify, sell, resell, or commercially exploit the Game or its Content.

• Decompile, reverse engineer, create derivative works, or attempt to extract the source code of the Game.

• The proprietary software and related documentation, or any enhancements or modifications thereto, provided to you in order to access the Game or its Content.

User Conduct

You agree to use the Game in compliance with all applicable laws and regulations. You further agree not to:

• Use the Game to engage in any unlawful or fraudulent activity.

• Interfere with or disrupt the Game's functionality or servers.

• Submit or transmit harmful content, including viruses or malware.

Security

We cannot and do not guarantee that the Game will be free from viruses or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of the Game and its Content.

Accounts

Some features of the Game may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Disclaimer of Warranties

To the maximum extent permitted by applicable laws, the Game is provided on an "as-is" and "as-available" basis. We disclaim all warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 

While we try our best to ensure that the Game and its Content are always available, up-to-date and correct, Silly Little Games LLC does not warrant that the Game will be uninterrupted, secure, error-free, or available at all times. There may be delays, omissions, interruptions, and inaccuracies in the Content or other material made available through the Game. You hereby acknowledge that the use of the Game is at your sole risk.

Limitation of Liability

To the maximum extent permitted by law, Silly Little Games LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Game.

Fees and Payments

We reserve the right at any time to charge fees for access to portions of the Game or the Game as a whole. In no event, however, will you be charged for access to the Game unless we obtain your prior agreement to pay such charges. Thus, if at any time we require a fee for portions of the Game that are now free, we will give you advance notice of such fees. You may cancel your account at any time. You must pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any digital products or services offered for sale through the Game by us or by any other vendor or service provider. All fees and charges will be billed to and paid for by you. You shall pay all applicable taxes relating to use of the Game through your account.

Termination

We reserve the right to terminate or suspend your access to the Game at our sole discretion, without prior notice.

Governing Law

These Terms are governed by and construed in accordance with Federal Laws and the laws of the State of California, without regard to its conflict of law principles.
